Terms of Service

1. Acknowledgement

These Terms of Service constitute a legally binding agreement between you and Pocketech PTY LTD regarding your use of the Pocket Forex application. By accessing the Service, you agree to be bound by all of these Terms.

2. Scope of License

We grant you a personal, non-exclusive, non-transferable, and limited license to use the Service on Apple-branded products that you own or control.

This license is for personal, non-commercial trading use only. You may not distribute or make the Service available over a network where it could be used by multiple devices at the same time.

3. Maintenance and Support

Pocketech PTY LTD is solely responsible for providing any maintenance and support services for the App. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

4. No Financial Advice (Important Disclaimer)

The Service, including all AI-generated signals, market analysis, and automated grid strategies, is provided for informational and educational purposes only. It does not constitute investment, financial, or trading advice. You acknowledge that Pocketech PTY LTD is not a registered investment advisor or broker. All trading decisions are made solely by you. Past performance of any signal or strategy is not a guarantee of future results.

5. Warranty Disclaimer

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, Pocketech PTY LTD disclaims all warranties, whether express or implied. We do not warrant that the AI signals will be 100% accurate, or that the delivery of data will be uninterrupted or error-free.

6. Product Claims

Pocketech PTY LTD, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App.

7. Intellectual Property Rights

All algorithms, software code, UI design, logos, and signal data are the exclusive property of Pocketech PTY LTD. In the event of any third-party claim that the App infringes intellectual property rights, Pocketech PTY LTD will be solely responsible for the investigation and settlement of such claims.

8. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. or Australian Government embargo; and (ii) you are not listed on any government list of prohibited or restricted parties.

9. Third-Party Agreements

You must comply with applicable third-party terms of agreement when using the App (e.g., your agreement with your mobile data vendor or your chosen third-party broker such as XM or Exness).

10. Modification of Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the “Last Updated” date. Continued use of the App constitutes your acceptance of the revised Terms.

11. Age and Legal Capacity

The Service is strictly intended for individuals aged 18 or older. By using the App, you represent that you have the legal capacity to enter into this agreement.

12. Your Responsibility for Your Account

You are responsible for maintaining the confidentiality of your login (email verification). You are liable for all activities that occur under your account.

You may delete your account at any time via the “Delete Account” button in the App settings or by contacting [email protected]. Upon deletion, all personal data will be removed or anonymized in accordance with our Privacy Policy.

13. Responsible Use of Pocket Forex

You agree not to: (i) reverse engineer or decompile the software; (ii) use any automated tools to scrape signal data; (iii) use the Service for any illegal financial activities.

14. Complaints and Content Violations

If you believe any content or signals within the App violate your rights or these Terms, please submit a complaint to [email protected].

15. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or our business interests.

16. Subscriptions

    1. Tiers and Cycles: We offer Basic, Pro, and Expert tiers on Weekly, Monthly, and Yearly billing cycles. Current pricing for each plan is displayed on the in-app purchase page.
    2. Automatic Renewal & Cancellation: Payment is charged to your Apple ID Account at confirmation. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. You may manage or cancel subscriptions in your App Store Account Settings.
    3. Payments & Refunds: All purchases are final. Refund requests for iOS transactions must be directed to Apple Support. Pocketech PTY LTD is unable to process refunds directly for App Store transactions.
